Procedural Posture

Succession Cause / Ruling on Application to Amend Grant and Confirm Mode of Distribution

  1. 1 Whether the grant of letters of administration should be amended to substitute a deceased administrator.
  2. 2 Whether any beneficiaries or dependants have been left out of the proposed distribution.

Ratio Decidendi

The court held that the Law of Succession Act does not provide for the substitution of a deceased administrator by amendment of the grant. Upon the death of an administrator, the grant becomes inoperative and a fresh appointment of administrators is required. In this case, since the grant had not been confirmed and no certificate issued, the applicant failed to provide sufficient reasons or evidence of consent from all beneficiaries for the proposed substitution. Furthermore, the court found that the individuals alleged to have been left out of the distribution did not meet the statutory threshold to be considered beneficiaries or dependants under Section 29 of the Law of Succession Act....

Court Disposition

Application for substitution of administrator denied; application for confirmation of grant and proposed mode of distribution allowed.

Orders

  • Prayer for substitution of the deceased administrator is denied.
  • Application for confirmation of grant is allowed.
