Ratio Decidendi

The court found that the rectification of the grant went beyond correcting minor errors and was used to remove the applicant as a beneficiary, thereby disinheriting her. The law on rectification does not permit the removal of confirmed beneficiaries or the reallocation of their shares. The court determined that the applicant was unjustly deprived of her entitlement through the rectification process, which was contrary to the intended scope of rectification under succession law. As a result, the rectified grant was set aside and the original certificate of confirmation reinstated to correct the injustice.
