The court held that once a person’s beneficial interest in an intestate estate has been identified and specified in the Certificate of Confirmation of Grant, it is legally protected as that person’s entitlement, regardless of whether it has been formally registered in their name. Any alienation or interference with that share, other than in accordance with the confirmed grant, is unlawful and will be restrained. The respondents’ act of leasing out the applicant’s share to a third party was found to be in violation of the confirmed grant and the Law of Succession Act.
