The court found that the grant issued to the 1st Protestor by the lower court was a nullity due to lack of jurisdiction, rendering all subsequent transactions, including sales to purchasers for value, void ab initio. Section 93(1) of the Law of Succession Act could not validate such transactions. The only property comprising the deceased’s estate was L.R. Mwimbi/Chogoria/261, which had not been validly transferred prior to the deceased’s death. The court held that, under the Law of Succession Act, the estate should devolve equally to the houses of the late M’Rithaa Miiru and the late Chabari Miiru, as they were the only claimants and direct descendants through deceased sons.
