Procedural Posture

Succession Cause / Ruling on Application for Stay Pending Appeal

  1. 1 Whether the High Court can grant a stay of execution of a negative order dismissing an application for revocation of grant pending appeal.
  2. 2 Whether the applicants are entitled to a stay of implementation of the certificate of confirmation of grant after the Court of Appeal has refused such stay.
  3. 3 Whether the estate property was held in trust for the larger Ndeti family or belonged solely to the deceased.

Ratio Decidendi

The court held that the orders sought to be stayed were negative in nature, being dismissals, and therefore incapable of being stayed as they did not require any party to act or refrain from acting. Furthermore, the applicants had already sought and been denied stay by the Court of Appeal, and it was not open to the High Court to revisit and grant the same relief. The court also noted the lack of evidence regarding the current status of the estate and whether the properties had already been distributed, making the application misconceived. Consequently, the application for stay was found to be without merit and was dismissed with costs.
