Order 24 Rule 4 and Order 51 Rule 1 of the Civil Procedure Rules, under which the application was brought, are not among those imported. Therefore, the application for substitution of the deceased co-administrator was incompetent for want of form and could not be entertained. The court relied on precedent and the explicit language of the relevant statutes and rules to strike out the application.
