The High Court lacks jurisdiction to determine disputes regarding the sale and ownership of land forming part of a deceased's estate, as such matters fall within the exclusive jurisdiction of the Environment and Land Court under the Constitution. The applicant's claim to the property must first be established in the Environment and Land Court before any alteration to the distribution of the estate can be made. To preserve the applicant's potential interest and prevent injustice, the disputed parcels are to be removed from the distribution schedule pending determination of title by the appropriate court.
