Justice Mshila to hear and determine the matter did not oust the jurisdiction of other High Court judges to address urgent applications when the assigned judge was unavailable. The High Court, as an institution, retains its constitutional and statutory jurisdiction, and the duty judge is mandated to address urgent matters to prevent injustice or prejudice. The interim orders issued on 20th and 22nd February, 2024 were within the jurisdiction of the court acting as duty judge and did not amount to taking over the substantive hearing of the matter from the assigned judge.
