Ratio Decidendi

The High Court found that the Senior Resident Magistrate Court lacked jurisdiction to issue a grant of letters of administration for an estate valued at over Ksh 1 billion, as Section 48 of the Law of Succession Act limited such jurisdiction to estates not exceeding Ksh 100,000. The respondents had concealed the true value of the estate, enabling the magistrate's court to assume jurisdiction unlawfully. The grant was therefore void ab initio for want of jurisdiction. The court held that any decision made without jurisdiction is unconstitutional and must be set aside. Consequently, the grant of letters of administration issued to the respondents was revoked and annulled, and further orders...
