Ratio Decidendi

The court held that while section 74 of the Law of Succession Act and Rule 43(1) of the Probate and Administration Rules limit rectification to errors in names and descriptions, the inclusion of a newly discovered asset is a fundamental change that ordinarily would not fall within the scope of rectification. However, invoking its inherent jurisdiction under Rule 73, the court found it appropriate to allow the rectification in order to meet the ends of justice. The court therefore granted the application and ordered the Certificate of Confirmation of Grant to be rectified as prayed, allowing the inclusion and distribution of the insurance policy to Esther Warau Kibata.
