Ratio Decidendi

The High Court determined that it lacked jurisdiction to grant the orders sought by the applicant regarding Kabete/Nyathuna/3253 because the property was not part of the estate before the court in the instant succession cause. The property had already been the subject of a separate succession proceeding in Kiambu RMCSC No. 325 of 2012, where the applicant had obtained confirmation of grant and the property had devolved to him. The lower court in Kiambu had correctly held that it was functus officio after confirming the grant and could not issue further orders regarding the title deed.
