Ratio Decidendi

The court found that the grant of letters of administration intestate was obtained on the basis of a false statement that the deceased was survived only by Simon Ngara Kabai, when in fact there were other surviving children. The failure to disclose all beneficiaries constituted fraud and rendered the proceedings defective under section 76 of the Law of Succession Act. As the application was unopposed and the allegations were uncontroverted, the court held that the grant and all consequential orders, including the confirmation of grant and transactions based on it, must be revoked and set aside.
