The appellate court found that the trial court erred in accepting the existence of nine beneficiaries without cogent evidence. The burden of proof was on the petitioner to establish the status of the disputed beneficiaries, which was not discharged. The chief's letter listing the beneficiaries was hearsay and not substantiated by testimony or documentary evidence. Only the petitioner and the two protestors (widows of deceased sons) were proven as rightful beneficiaries. The estate, consisting of land parcel LR NO. CHANIA/KANYONI/508, should be distributed according to Section 40 of the Law of Succession Act, with two-thirds going to the first house (shared equally by the two protestors)...
