Ratio Decidendi

The court found that the applicants failed to meet any of the grounds for review under Order 45 of the Civil Procedure Rules. The matters raised were not new or previously undiscoverable, as the applicants were aware of the succession proceedings and had opportunities to participate. No error apparent on the face of the record was demonstrated, and no sufficient cause for review was established. The court also held that, since the threshold for review was not met, the injunctive orders sought with respect to the subdivision of Kericho/Koiyet SS/168 could not be granted. The applications were therefore dismissed.
