Ratio Decidendi

The court held that substitution of a deceased administrator is not available unless there is a continuing trust and only one surviving administrator, as per Section 81 of the Law of Succession Act. The application for amendment of the certificate of confirmation of grant to introduce new beneficiaries and alter the distribution is not permissible under Section 74, which only allows rectification for minor errors. Fundamental changes to the distribution or addition of beneficiaries require a review of the confirmation orders, not a mere amendment of the certificate. The application was therefore dismissed as not well founded or properly conceived.
