The court was not persuaded that the collection of the grant by Francis Albert Makokha, who was not an applicant, constituted notice to the applicants. Accordingly, the court exercised its discretion to grant leave to appeal out of time and ordered a stay of transmission of the estate pending the filing and hearing of the intended appeal, with the stay lapsing if the appeal is not filed within 45 days.
