The court found that none of the properties listed in the petition for grant of representation were registered in the name of the deceased at the time the succession cause was filed. The applicant successfully demonstrated that at least one property, Kisekini 412, was not part of the deceased's estate, and there was consensus that Nthaani 676 was also not registered in the deceased's name. The respondents conceded these facts. As such, the inclusion of these properties rendered the proceedings defective in substance, warranting revocation of the grant under Section 76 of the Law of Succession Act.
