Ratio Decidendi

The court found that the applicant, although a petitioner for letters of administration, had not yet been appointed as administrator of the estate. Without such appointment, he lacked the legal capacity (locus standi) to seek injunctive orders for preservation of the estate or to restrain other beneficiaries. The powers to preserve the estate and prevent inter-meddling are vested in the administrator, not in a mere petitioner. As such, the application was not properly before the court and was struck out for want of locus standi.
