The court found that the assets listed in the petition for grant of probate in respect of Margaret Nyarangi Moragwa were substantially the same as those confirmed to her as trustee for the children of James Onyiego Nyarangi in HCSC No. 1092 of 1991. The confirmation of grant did not vest absolute ownership in Margaret Nyarangi but created a trust, with her holding the property on behalf of the beneficiaries. Under Sections 3(1) and 5(1) of the Law of Succession Act, only free property—property a person can freely dispose of during their lifetime—can be disposed of by will. Since the property was subject to a trust and not free property, Margaret Nyarangi could not lawfully will it away....
