Ratio Decidendi

The court found that the protestors failed to discharge the burden of proving that the deceased lacked testamentary capacity or that the Will was procured by coercion or fraud. The evidence from the advocate and the executor established that the deceased was of sound mind, understood the contents of the Will, and executed it voluntarily. The illness from which the deceased suffered (arthritis) did not affect her mental faculties or capacity to make a Will. The Will was executed in accordance with the legal requirements under the Law of Succession Act. Accordingly, the Will dated 21st November, 2015 was declared valid, and the grant was confirmed as prayed.
