The court held that, in the presence of a continuing trust within the estate, the law prohibits the appointment of a sole administrator unless the administrator is the Public Trustee or a Trust corporation. Since the administratrix is neither, and there are minor beneficiaries, the proceedings cannot continue with only one administratrix. The applicant, being a beneficiary and from a different house, strengthens the need for joint administration, potentially with a separate trustee for each house as per the Law of Succession Act.
