IN THE MATTER OF THE ESTATE OF MARTIN OKWARO ARODI alias WILLIAM MARTIN OKWARO - (DECEASED)
Ruling
1. On 12th June 2024, all the parties to this cause appeared in court for adoption of the Mediation Settlement Agreement dated 15th May 2024.
2. They were all in agreement as to the mode of distribution of the estate of the deceased Martin Okwaro Arodi alias William Martin Okwaro.
3. However, the adoption of the Mediation Settlement Agreement was going to pose an implementation challenge and the parties were directed to file a consent to modify the distribution.
4. The parties have now filed the schedule of distribution modifying the Mediation Settlement Agreement.
5. I have perused the signed modified mode of proposed distribution of the estate of Martin Okwaro Arodi alias William Martin Okwaro dated 26th June 2024. I am satisfied that it addresses all the concerns raised on 19th June 2024.
6. I adopt the Mediation Settlement Agreement and its modification dated 26th June 2024 as the order of this court.
7. I proceed to confirm the grant and direct that the certificate of confirmation of grant do issue forthwith reflecting the mode of distribution of the estate as agreed upon in the Mediation Settlement Agreement dated 15th May 2024 and modified by consent on 26th June 2024.
8. Subject to Section 83 of the Law of Succession Act, on rendering of full and accurate accounts of the estate by the Administrations within six (6) months of today, this file is closed.
9. I so order.
