Ratio Decidendi

The court found that the respondent, being a niece, did not rank in priority to the applicant, who was the deceased's sister, under Section 66 of the Law of Succession Act. The respondent failed to notify or obtain consent from the applicant and other beneficiaries, and concealed their existence from the court. The grant was therefore obtained fraudulently and in contravention of the statutory requirements. The respondent's actions amounted to intermeddling, and any subsequent transactions involving the estate were null and void. The court held that the applicant was entitled to be appointed as administrator, and the grant issued to the respondent was revoked.
