The High Court (Succession Division) lacks jurisdiction to determine the issue of whether the applicant was registered as trustee for his father in respect of Kanyamkago/Kawere I/xxx. Such a dispute, involving ownership and declaration of trusts over land, falls exclusively within the jurisdiction of the Environment and Land Court as per Article 165(5) of the Constitution and Section 13 of the Environment and Land Court Act. The Law of Succession Act must be construed in conformity with the Constitution, and the court cannot act outside its jurisdiction.
