The 2nd applicant was not a party to the mediation proceedings and had not shown that his presence was necessary for the resolution of the issues in the suit. As a stranger to the proceedings, the 2nd applicant could not properly move the court to set aside the mediation settlement agreement or to seek orders regarding the administration of the estate. Consequently, the application was found to lack merit and was dismissed.
