The court found that while the petitioner failed to include all family members and did not ensure the title was registered in trust as per the certificate of confirmation of grant, the omission did not prejudice any party, as the second house had already received and distributed their share of the estate and had not objected. The objectors, being grandsons, were to inherit through their late father, whose name was included. The only property available for distribution was Machakos/Kiandani/1750, as the other parcels had already been distributed in a separate succession cause.
