Ratio Decidendi

The court found that the application for rectification of the certificate of confirmation of grant was merited because the errors identified were clerical in nature, relating to the names of the deceased and beneficiaries, and the distribution of land parcels. All beneficiaries had consented to the rectification and redistribution, and there was no objection. The court held that under Section 74 of the Law of Succession Act, it has jurisdiction to rectify such errors without affecting the substance of the grant. The application was therefore allowed as prayed, and the certificate of confirmation of grant was ordered to be rectified accordingly.
