Ratio Decidendi

The court found that the applicant met the conditions for grant of stay of proceedings pending appeal, except for the requirement to explain why the stay was not sought in the appellate court. However, the extraordinary circumstance that the applicant and interested party have lived on the disputed properties for over 20 years justified the grant of stay to prevent the risk of rendering the appeal nugatory and potentially making them homeless. The court also determined that transferring the cause to Kakamega was not justified at this late stage, given the progress in Nairobi and the pending appeal in the Nairobi Court of Appeal. Each party was ordered to bear its own costs.
