The court found that the alleged oral will did not meet the statutory requirements under Section 9(1) of the Law of Succession Act, as the deceased did not die within three months of the alleged oral declaration and there was insufficient evidence of its making. Consequently, the estate was to be distributed under the law of intestacy. Section 35 of the Law of Succession Act and the Constitution require non-discrimination in inheritance, and customary law cannot override statutory and constitutional provisions.
