Consequently, the applicant could not enforce any interest in the land against the deceased's estate. Furthermore, the land in question had already been transferred and registered in the name of a third party, Lawrence Kiriinya Ibuuri, making it no longer part of the deceased's estate and thus outside the scope of the succession proceedings.
