However, the applicant's claim regarding the suit property was upheld because he had acquired title to Kaplamai/Sirende Block 2 (Ngonyek) 225 before the deceased's death. As such, the property did not form part of the deceased's estate at the time of her death and could not be distributed under the succession proceedings. Any allegations of fraud in the acquisition of the property must be pursued in a different forum, as succession proceedings are limited to assets registered in the deceased's name at death.
