Procedural Posture

Succession Cause / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicants are entitled to a stay of execution of the confirmed grant pending appeal.
  2. 2 Whether the application for stay was filed without inordinate delay.
  3. 3 Whether the confirmed grant complied with Section 40(1) of the Law of Succession Act.

Ratio Decidendi

The court found that while the applicants had demonstrated the existence of an arguable appeal and the risk of substantial loss if the stay was not granted, they failed to satisfactorily explain the delay of approximately eight months in filing the application for stay. The delay was deemed inordinate and not justified. However, in balancing the interests of justice and the overriding objective of the case, the court allowed the application for stay but ordered the applicants to pay the costs of the application as a consequence of the delay.

Court Disposition

Application for stay of execution allowed; applicants to pay costs of the application.

Orders

  • Stay of execution of the orders confirming the grant issued on 22nd July 2009 pending the hearing and determination of Court of Appeal Civil Appeal Number 246 of 2009.
  • Applicants shall pay the costs of the application.
