The court found that the applicant, Joseph Kauro Itirai, was a rightful beneficiary who had been excluded from the administration and distribution of the estate. The grant issued to Magdaline Muthoni and later to Cyprian Mwiti was obtained without involving the applicant, rendering the proceedings defective. The court held that the applicant was entitled to LR Nkuene/Nkumari/1650, and there was no satisfactory reason to deprive him of this inheritance in favor of his wife and daughter while he was still alive. The court also noted that other beneficiaries had received and even sold their shares, and it was not proper for them to dictate how the applicant should deal with his inheritance....

  • LR Nkuene/Nkumari/1650 previously devolved to Magdaline Muthoni Itirai shall now be devolved to the applicant; registration in the name of Magdaline Muthoni M’Itirai is cancelled.
