The court held that previous benefits given to John, Francis, and Silas by the deceased during his lifetime must be considered in the distribution of the estate. John, having already received two acres, is not entitled to a share of the suit property. The purported sale of estate land to Mbogori by John and Silas before confirmation of the grant was void under the Law of Succession Act, and Mbogori cannot claim a share or refund from the estate.
