The court further held that all children of the deceased, including daughters, are entitled to an equal share of the estate, regardless of gender or marital status, as required by the Constitution and the Law of Succession Act. Customary law practices that discriminate against women in matters of inheritance are unconstitutional and cannot be enforced.
