Procedural Posture

Succession Cause / Ruling on Application for Joinder as Interested Party

  1. 1 Whether the applicant, as the widow of a purchaser from beneficiaries, is entitled to be enjoined as an interested party in the succession proceedings.
  2. 2 Whether the applicant has a protectable interest in the estate of the deceased under Section 93 of the Law of Succession Act.
  3. 3 Whether the applicant's claim should be pursued against the beneficiaries or within the succession cause.

Ratio Decidendi

The court found that the applicant's entitlement did not arise from the deceased's estate but from a purchase transaction with the beneficiaries. Since the estate had already been distributed and a certificate of confirmation of grant issued, and because Section 93 of the Law of Succession Act did not protect her claim in these circumstances, the applicant's interest could not be properly articulated in the succession proceedings. The appropriate forum for her claim was against the beneficiaries in the Environment and Land Court. Accordingly, the application for joinder as an interested party was dismissed for lack of merit.
