Ratio Decidendi

The court found that the estate of the deceased had already been distributed and vested in the beneficiaries as per the Certificate of Confirmation of Grant dated November 11, 2019. The death of Gladys Kathure M’Ngaruthi occurred after the grant, and any administration of her estate must be pursued separately, not within the current succession cause. The application to administer her estate within this cause was therefore untenable. However, the court reviewed the Certificate of Confirmation of Grant to the extent that the distribution in favour of Gladys Kathure M’Ngaruthi shall vest in her estate, and ordered that the certificate be amended accordingly.
