The sale of part of the estate before confirmation of the grant was irregular and void. The court held that, under section 40 of the Law of Succession Act, the estate of a polygamous intestate should be distributed equally between the houses. The court revoked the previous grant and ordered a fresh grant to be issued jointly to representatives from both houses, with the estate to be divided equally between them.
