Ratio Decidendi

The court found that the deceased died intestate, as there was no will or credible evidence of a prior subdivision or inter vivos gift. The evidence presented by the protestors was insufficient and uncorroborated, particularly as key witnesses and documentary proof were lacking. The court held that the estate must be distributed equally among the families of the deceased's three sons, in accordance with Section 38 of the Law of Succession Act. The protestors' proposal was found to be discriminatory and contrary to the law, as it sought to favour one branch of the family over the others. The applicant's proposal for equal distribution was deemed lawful and equitable.
