Ratio Decidendi

The court found that both the widow (including a former wife) and the children of the deceased rank equally in priority to petition for letters of administration intestate under the Law of Succession Act. There is no legal bar to a former wife applying for letters of administration. Given the polygamous nature of the deceased's family, the fairest solution is to have one representative from each house jointly petition for the grant. The citation to compel the citees to take out letters of administration was therefore without merit and dismissed. The court directed the parties to present the names of one representative from each house within fourteen days.
