The court held that, although the deceased died before the Law of Succession Act came into force and customary law would ordinarily apply, the application of African customary law in this case would violate Article 27 of the Constitution, which prohibits discrimination on the basis of sex. The Law of Succession Act, as read with the Constitution, requires equal treatment of sons and daughters in the distribution of an intestate estate.
