Procedural Posture

Succession Cause / Ruling on Application for Review of Distribution Order

  1. 1 Whether the applicant has established sufficient grounds for review of the court's distribution order under section 80 and Order 45 of the Civil Procedure Rules.
  2. 2 Whether the alleged error in distribution constitutes an error apparent on the face of the record or is a ground for appeal rather than review.
  3. 3 Whether the delay of six years in bringing the application for review is justifiable.

Ratio Decidendi

The court held that the applicant failed to establish any of the grounds required for review under section 80 and Order 45 of the Civil Procedure Rules. The alleged error in distribution, if any, was a matter of law and thus a ground for appeal, not review. The court further found the six-year delay in bringing the application to be inordinate and unjustifiable. The applicant's claim that sons have superior inheritance rights over daughters was rejected as contrary to current legal principles of gender equality. Consequently, the application for review was dismissed with costs to the respondent.
