The court found that the deceased had, during his lifetime, allocated portions of his land to his sons, some of whom had already benefited from other parcels. The administrators failed to rebut the protestor's evidence that certain beneficiaries had received gifts inter vivos and had settled and developed their respective portions. Applying section 42 of the Law of Succession Act, the court held that equal distribution would be unfair to the protestor, as it would disregard the prior benefits received by other beneficiaries.
