The court found that the Objector failed to properly challenge the affidavit of service, as he did not file a further affidavit or seek to cross-examine the process server. The presumption of proper service therefore stood uncontroverted. The court held that the explanation for non-attendance, based on counsel's mistake in diarising the date, was not bona fide and amounted to a contrived ground. Judicial discretion to reinstate a cause must be exercised on the basis of evidence and sound legal principles, and in this case, the Objector's application was not supported by sufficient or credible grounds. As such, the application for reinstatement was dismissed for lack of merit.
