The court held that it is not the appropriate forum to determine the dispute over the alleged sale of 9 acres of land by the deceased to the petitioner, as such issues fall outside the jurisdiction of the probate court and should be determined by the Environment and Land Court (ELC). The probate court's role is limited to distributing the free property of the deceased, and it cannot adjudicate on ownership or enforce sale agreements. Accordingly, the grant previously issued was revoked and a new administrator appointed. The confirmation of grant and distribution of the estate will be held in abeyance pending the petitioner's institution of a substantive suit in the ELC within 60 days to...
