Section 66 of the Law of Succession Act provides a clear order of preference for grant of letters of administration, with the public trustee only considered after all beneficiaries have been exhausted. The applicant did not exhaust the list of beneficiaries before seeking to involve the public trustee. Furthermore, the court found that it had already issued a citation upon the applicant's application and was therefore functus officio regarding that citation; it could not vary...
