Procedural Posture

Succession Cause / Ruling on Summons for Revocation of Grant

  1. 1 Whether the subdivision of the estate property into seven portions instead of eight, excluding the widow, justifies revocation of the grant.
  2. 2 Whether the administrator acted without the involvement and consent of all beneficiaries in the administration of the estate.
  3. 3 Whether the sale and subdivision of the estate property without court approval amounted to intermeddling.

Ratio Decidendi

The court found that although the subdivision of the estate property into seven portions instead of eight, and the exclusion of the widow, was irregular and contrary to the confirmed grant, the applicants failed to establish grounds for revocation of the grant under section 76 of the Law of Succession Act. The evidence showed that the subdivision was done with the concurrence of all beneficiaries, including the applicants, and that the administrator did not act fraudulently or conceal material facts from the court. However, the sale and subdivision of the estate property without court approval amounted to intermeddling, which is a criminal offence under section 45 of the Law of Succession...

Court Disposition

Application for revocation of grant dismissed; all subdivisions and transfers of the estate property declared null and void; parties to bear own costs.
