Procedural Posture

Probate and Administration / Ruling on Confirmation of Grant and Distribution of Estate

  1. 1 Whether the distribution of the estates of Ngusye Mbole, Ngina Mbole, and Mwikali Mbole should follow the arbitrator's award.
  2. 2 Whether the court can alter or set aside the judgment entered as per the arbitrator's award.
  3. 3 Whether all beneficiaries have consented to the proposed distribution.

Ratio Decidendi

The court held that the distribution of the estates of Ngusye Mbole, Ngina Mbole, and Mwikali Mbole must be in accordance with the arbitrator's award, which was adopted as a judgment of the court on 29 November 2007. Since the judgment had not been set aside or vacated, the court was bound by it and could not alter the terms of distribution. The Deputy Registrar was ordered to translate the award into English, and the grant was to be confirmed in the terms of the award. Any attempt to tamper with the award or the orders of the previous judge would be illegal. Costs were ordered to be in the cause.

Court Disposition

Grant confirmed as per arbitrator's award; distribution to proceed accordingly.

Orders

  • Distribution of the estate shall be as per the arbitrator's award dated 19.9.2005 and filed in court on 30.3.2006.
  • Deputy Registrar to have the award translated into English.
