Procedural Posture

Succession Cause / Ruling on Application for Review of Judgment

  1. 1 Whether the applicant has established grounds for review of the judgment on distribution of the deceased's estate.
  2. 2 Whether an error apparent on the face of the record exists to warrant review.
  3. 3 Whether the inclusion or exclusion of certain parcels and beneficiaries was proper under the Law of Succession Act.

Ratio Decidendi

The court found that the applicant's grounds for review did not meet the threshold required under Order 45 Rule 1 of the Civil Procedure Rules. The alleged errors were not self-evident but rather matters that should be canvassed on appeal. The original judgment had properly considered the provisions of the Law of Succession Act, including previous benefits to beneficiaries. The application was therefore dismissed. However, to address practical difficulties in implementing the judgment and to restore the status quo, the court ordered the cancellation of subsequent subdivisions and required the parties to file a consent on the subdivision of the estate, failing which the court would intervene.

Court Disposition

Application for review dismissed. Ancillary orders issued to restore and manage the estate.
