Succession Cause / Ruling on Objection to Confirmation of Grant

  1. 1 Whether the objection to confirmation of grant is competently before the court.
  2. 2 Whether the summons for confirmation of grant filed by the petitioner should be struck out.

Ratio Decidendi

The court held that an objection to confirmation of grant is not competent if filed after the grant has already been issued. The Law of Succession Act and the Probate and Administration Rules provide that objections must be made before the grant is issued, and any contest to the proposed distribution at the confirmation stage must be by way of affidavit of protest. Since the objector's affidavit was filed after the grant had been issued, it was incompetent and could not be entertained. Court Disposition

Objection dismissed; liberty to file affidavit of protest granted.

Orders

  • The prayers sought by the objector and interested party are denied.
  • The objector and interested party are at liberty to file and serve affidavits of protest to the summons for confirmation of grant within 60 days of the date of this ruling.
